These Terms of Service ("Terms") govern your access to and use of the Zim 3D Prints website (zim3dprints.com), our products, and any purchases you make from us online, at festivals, or at other in-person events (collectively, the "Services"). Zim 3D Prints is operated by Zimzores Enterprises LLC, doing business as Zim 3D Prints ("Zim 3D Prints," "we," "us," or "our"). By accessing our website, placing an order, or making a purchase from us, you agree to be bound by these Terms. If you do not agree, please do not use our Services. 

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase from us. If you are under this age, you may only use our Services with the involvement of a parent or legal guardian.

2. Products & Custom Orders

Most items sold by Zim 3D Prints are 3D-printed to order. Because of this, colors, textures, and minor finish details may vary slightly from product photos, and small layer lines or texture variations are a normal part of the 3D printing process rather than defects.

We also accept custom order requests. Custom orders are quoted individually, and once production begins, custom and bulk orders become final sale and are non-refundable. See our Refund Policy for full details.

Some product listings feature "mystery" or blind-box style items where the exact design or color is randomly assigned at the time of production or pickup. By purchasing these items, you acknowledge and accept that you will not know the specific variation you will receive in advance.

3. Materials & Product Safety

Our products are printed primarily in PLA and PETG plastic filaments. Please note the following:

  • Our products are decorative or functional items and, unless explicitly stated in the product listing, are not intended for food or beverage contact, are not dishwasher or microwave safe, and should not be exposed to prolonged high heat (such as inside a hot car or near an open flame).
  • Some items contain small parts, magnets, or detachable pieces and may pose a choking hazard. These items are not intended for children under 3 years of age unless otherwise stated.
  • Some items may be subject to California Proposition 65 disclosure requirements. Where applicable, we provide these disclosures on the relevant product listing.
  • Products are sold as decorative items, collectibles, or novelty goods and are not toys or safety-tested children's products unless specifically labeled as such.

4. Intellectual Property & Licensed Designs

All content on this website, including product photography, descriptions, logos, and branding, is the property of Zim 3D Prints, LLC and may not be copied, reproduced, or used without our permission.

Some of the designs we print are created by independent third-party designers and used under license (credited where applicable in the product description). The purchase of a physical printed item from us grants you ownership of that physical object only. It does not grant you any right to reproduce, 3D print, scan, redistribute, resell, or create derivative works from the underlying design file, whether created by Zim 3D Prints or a third-party designer, unless expressly stated otherwise.

5. Ordering, Pricing & Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or inventory unavailability. If we cancel an order after payment has been collected, you will receive a full refund.

You are responsible for providing accurate order and shipping information at checkout. We are not responsible for orders delayed or misdirected due to incorrect information provided by the customer.

6. Shipping & Delivery

Shipping timelines, methods, and rates are described in our Shipping Policy. Estimated delivery dates are not guaranteed.

7. Returns, Refunds & Cancellations

Our full return, refund, and cancellation terms, including terms specific to festival and in-person purchases, are described in our Refund Policy, which is incorporated into these Terms by reference.

8. Festival & In-Person Sales

We sell at festivals, markets, and other in-person events in addition to our online store. Sales tax nexus, applicable local regulations, and our final-sale policy for in-person purchases apply as described in our Refund Policy. At in-person events, we operate under whichever business location and tax jurisdiction applies to that specific event.

9. Prohibited Conduct

When using our Services, you agree not to:

  • Violate any applicable law or regulation;
  • Use our Services for any fraudulent or unauthorized purpose;
  • Attempt to interfere with, disrupt, or gain unauthorized access to our website or systems;
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services or our licensed designs without our express written permission;
  • Submit false or misleading information when placing an order.

10. Disclaimer of Warranties

Our Services and products are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be excluded under applicable law. We do not warrant that our products will meet your specific expectations regarding color matching, exact dimensions, or minor cosmetic variations inherent to the 3D printing process.

11. Limitation of Liability

To the fullest extent permitted by law, Zim 3D Prints, LLC, its owners, members, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of our Services or products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your purchase shall not exceed the amount you paid for the applicable product.

This limitation does not apply to damages caused by our gross negligence or willful misconduct, or where such limitation is not permitted by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Zim 3D Prints, LLC, its owners, members, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of our products, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your purchase shall be resolved in the state or federal courts located in Alabama, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
